158.4 Francis HAMILTON d. 1821, Jefferson Co., VA, s/o Francis HAMILTON (158), m. 22 Jul 1800, Frederick Co., MD, Catherine PHILPOTT b. prob. c1778, Frederick Co., MD, d. 18 Feb 1861, age 83, Frederick Co., MD (buried Mt. Olivet Cem., Frederick, Frederick Co.). Francis received from his uncle Alexander Hamilton Negro "Anthony" a carpenter-to have at testator's decease, to have the sum of money sufficient for his clothes and maintenance until he arrives at the age of 21 and at age 21, to have the principal from the sale of the personal estate. Francis and Catherine probably lived in Frederick for some part of their married life, but by 1809, they were living in Jefferson Co., VA. On 21 May 1802, Francis sold to Henry Strider 40 1/2 acres fro $405, the tract of land inherited from his father. On 26 Dec 1818 he swore in a deed at Charles Town, Jefferson Co., that his slaves were legally transported out of Maryland into Virginia. Maryland evidently believe they were illegally transported in violation of a law in 1817 that provided slaves who might otherwise be freed in Maryland could not be transported out of state where they might be kept in slavery for the rest of their lives. The disposition evidently satisfied the state of Maryland. In 1820 Francis was in Jefferson Co., with 3 males under 10 (Walter, Charles P., John T.), 1 male 10-16 (Henry A.), 1 Male 16-26 (Francis F.), 2 males 45 and up (Francis; the other could be brother Thomas who probably never married), 1 female under 10 (Susan), 1 female 10-16 (Mary B.), 1 female 16-26 (Catherine A. E.), and 1 female 26-44 (Catherine). 1 person a foreigner not naturalized, 1 in agriculture, 1 in commerce, 2 male slaves under 14, and 2 male slaves 14-16. The slaves transported were Zachariah age 40, a blacksmith, Henley 24, a blacksmith, a black orphan boy age 14, Phillis 45, Harriet 20, Susan 24, Bill 2, s/o Harriet, and Harryette 5 mo. d/o Susan. On 11 Jan 1822 a deed involving Catherine of Jefferson Co., VA, widow of Francis, Garland Moore the 2nd. part, and Stephen Cromwell and Vincent Moore, the 3rd. part, bound to Jacob Bedinger, Sheriff, from Shepherdstown for $1100 securities for Catherine, sold to Garland Moore 1 Negro man Henley 27, one Negro woman Susan and her children Henry, Maria, and Silver, plus corps and household goods, all property bought by Catherine at the sale of her deceased husband's estate sale on 5 Dec 1821. Catherine must pay the $1100 by 5 Sep or Garland Moore may sell the property at public auction. The deed was witnessed by F. A. HAMILTON, J. L Ransom, and Henry A. HAMILTON. In Francis' estate on 23 Sep 1827, most of the slaves are listed as property with the exception of those missing from the 1822 list (Zachariah, Silver, orphan boy; Harriet now had a child Sarah Ann. At a sale on 5 Dec 1822, Mrs. C(atherine) HAMILTON, John HAMILTON, and Mrs. BAKER (Jacobina) made purchases. On 8 Mar 1853 the final account of Francis' estate included family names of Jose P. ADAMS, Jacobina BAKER, Corbin BAKER (s/o Walter), and Walter BAKER #78); also the final entry included the name of all of the children, who each received $98.01. Henry A. HAMILTON was named guardian of the minor children Walter B., Charles P., and Catherine A. E. This is confusing in that they could not have been minor children in 1853, although they were probably minors at the time of their father's death in 1822. Catherine may have moved back to Petersville, Frederick Co., MD by 1832, when daughter Mary B. HAMILTON was married stating that she was from Petersville. Francis was on the list of Parish Members of St. Mark's Church, Petersville from 1806 through 1814. Francis' death and that he had several children among them Susan KELLER, w/o William KELLER living in VA, were mentioned in an Equity Case in Frederick Co., MD, Lingan Boteler vs. Henry Philpott. (MDB6 v9 p175, v10 p153, v12 p153, MDFRB29 p72, 57-58, MDPG17 p430, WVJEB19-2 p387, 3 p389, 13 p432, WVJEB 21-8 p161, 10 p438, 16 p296) Children (probably not in order of birth):
